TERMS & CONDITIONS
The purchase of packages or air only offered by VARAPLAYA TOURS constitutes a contractual agreement between VARAPLAYA TOURS and the customer; this implies your acceptance of VARALAYA TOURS' Terms and Conditions. Please ensure you read carefully and understand these Terms and Conditions prior to booking.
PRODUCT DESCRIPTIONS:
VARAPLAYA TOURS has put forth all necessary efforts to ensure that, at time of publication, all products' descriptions on this brochure are accurate. For several reasons beyond the control of VARAPLAYA TOURS, modifications can take place during the season which may affect products' descriptions. All hotel photographs are published as illustrations of the property only. Most of hotels offer various rooms with different decor, locations, size and bedding. VARAPLAYA TOURS cannot be held responsible if some of the services, facilities or bonus features cease to be available or are interrupted.
PRICES INDICATED:
Prices are quoted in Canadian dollars (CAN$), unless otherwise indicated, and are based upon the prices of service providers, the exchange rate, the cost of fuel, taxes and other fees in force at time of preparation of the brochure. All prices are valid upon date of publication and are subject to change without notice. Unless the customer has paid in full, all prices may be increased at any time and for any reason. Price reductions are applicable to new bookings only.
CHILDREN AND INFANT:
Unless stated otherwise, child fares apply to those aged 2-12 sharing a room with two adults. Some of hotels offer special rates for children sharing a room with a single adult.
Infants under two (2) years of age (at date of completion of travel), travel free of charge (with exception of the Cuban Tourist Card Fee) provided they do not occupy a seat (flight reservation must be made) and no meal service is provided.
EARLY BOOKING BONUS:
This offer may not be combined with any other offer and applies to the prices indicated in the brochure only. Savings are based on double occupancy.
DEPOSIT:
A deposit of $250 per person is required at time of booking. Final payment must be received by VARAPLAYA TOURS office at least 45 days prior to departure or no later than the final date specified for the Early Booking Bonus promotion. If payments are not received within the specified time period, VARAPLAYA TOURS reserves the right to cancel the reservation and apply the applicable penalties.
FINAL PAYMENT:
Payment in full must be received by VARAPLAYA TOURS at least forty-five (45) days prior to the date of departure. Reservations made less than forty-five (45) days prior to the date of departure must be accompanied by payment in full. If final payment is not received within the required period, VARAPLAYA TOURS reserves the right to cancel any such reservations without prior notice and levy applicable cancellation fees as indicated in the section of these Terms and Conditions.
PAYMENT BY CREDIT CARD:
VARAPLAYA TOURS accepts payments by Visa, Mastercard and American Express cards. Your verbal authorization given by the customers to VARAPLAYA TOURS for the use of a credit card confirms the reservation, whether or not the draft is signed. In the event that a cardholder refuses to honor a charge due to the absence of their signature and imprint of the credit card, the Travel Agent will be held responsible for the payment due to VARAPLAYA TOURS.
VARAPLAYA TOURS reserves the right to apply banking service fee for all changes of form of payment.
SPECIAL REQUEST:
VARAPLAYA TOURS will do the best to accommodate your requests (room allocation, bed preferences, adjoining rooms, etc.). However, we cannot confirm these prior to departure and VARAPLAYA TOURS cannot be held responsible if such requests cannot be fulfilled, but if so, the hotel and/or airline may levy fee(s) for these service(s) rendered.
SPECIAL NEEDS PASSENGERS:
All passengers requiring special care, assistance, attention or treatment must advise VARAPLAYA TOURS and the air carrier of any and all specific needs at the time of booking. VARAPLAYA TOURS cannot guarantee that the destination airport, coaches, accommodations will be accessible for passengers’ needs special care. VARAPLAYA TOURS and the suppliers reserve the right to refuse passengers who seem unlikely to complete a trip, or for whom such a trip could prove dangerous to themselves or others around them. A disabled passenger must provide a doctor’s certificate authorizing the passengers’ ability to travel.
INSURANCE:
We strongly recommend that all passengers purchase travel insurance, including trip cancellation insurance and out of province health insurance at time of booking.
BOOKING CHANGES:
IF WE CHANGE YOUR BOOKING:
If confirmed Travel Services are no longer available prior to the departure date or subsequent to arrival at destination, VARAPLAYA TOURS reserves the right to substitute them for comparable alternate Travel Services, or, alternatively, to cancel them. If the substituted Travel Services are of lesser value, the liability of VARAPLAYA TOURS shall be limited to the sole difference in cost. If the substituted Travel Services are of greater value, the customer will be required to disburse an amount equal to the difference between the price of the Travel Services purchased and that of the substituted Travel Services. The customer will be entitled to refuse such substitutions. In such a case, and in the event of a cancellation, the liability of VARAPLAYA TOURS shall be limited to the reimbursement of the price of Travel Services paid by the customer.
IF YOU CHANGE YOUR BOOKING:
Any change to a booking requested by customer, will be subject to the following charges:
a. Change in customer's name:
For all changes of customer names, last names or an added or suppressed a character, a fees will apply:
Before travel documents issued: 10$ per change.
After travel documents issued: 30$ per change.
Complete change of customer names will be treated as a cancellation and cancellation fees will apply.
b. Change of room category:
21 days prior to departure: 25$ per person.
20 days or less prior to departure date: 50$ per person.
c. Change of hotel:
21 days prior to departure: 50$ per person.
20 days or less prior to departure date: will be treated as a cancellation and cancellation fees will apply.
d. Change in date:
21 days prior to departure: 250$ per person.
20 days or less prior to departure date: will be treated as a cancellation and cancellation fees will apply.
CANCELLATION CHARGES:
The following charges will apply in the event of any cancellation:
For Packages, flights and Early Booking Bonus:
45 days or more prior to departure date: $250 per person
21 to 44 days prior to departure date: 50 % of total package cost per person.
20 days or less prior to departure date: 100% of total package cost per person.
No refunds including taxes will be made by VARAPLAYA TOURS for services unused and/or no show passenger subsequent to departure. All cancellation fees must be calculated based on the total amount of the products and Travel Services purchased including GST/PST.
TRAVEL DOCUMENTS AND CUSTOMS: It is the traveler’s responsibility to obtain at their own expenses all required documentation needed by al relevant governments. Canadian Citizens born in certain countries may require a visa in addition to a valid passport. A permanent resident card will be required for permanent residents/landed immigrants who are not Canadian citizens. One (1) parent traveling with a child under age eighteen (18) may have to obtain a notarized letter of consent signed by the parent not traveling. Customers are responsible for checking which documents are required, and then making certain that they have the necessary documents in hand prior to departure. Customers failing to provide the required documents may be denied boarding privileges by the carrier or relevant authorities, without further recourse or the possibility of a refund. Entry to another country may also be refused even if the required information and travel documents are complete.
TRAVEL SERVICES DOCUMENTS:
Airline tickets and other related travel services vouchers will only be delivered to Travel Agency, once VARAPLAYA TOURS has received payment in full for the Travel Services. Reservations made within fourteen (14) days or less of the date of departure is automatically assigned for pick-up at the airport. It is the responsibility of customers and travel agents to ensure that the information appearing on the airline tickets, vouchers and other travel documents is consistent with booking arrangements. Infant under 2 years must possess tourist card for travel to Cuba. All travel services documents are non-refundable and are valid only for flights and date purchased and cannot be exchanged for other flight. Travels documents lost or stolen are not refundable will be subject to reissue fee. No refund or replacement will be given for lost or stolen travel documents.
AIR TRANSPORTATION:
1. Flights and carriers:
Flights offered by VARAPLAYA TOURS are conducted in accordance with the applicable conditions of the air carrier as <<INCLUSIVE TOUR CHARTER>> and pursuant to regulations set out by the Canadian Transportation Agency. All such flights and rates are also subject to approval by the relevant government authorities.
All flight time, aircraft, carriers and flight itineraries are subject to change without notice. We highly recommend that customer contact the airlines of the airports at least 12 hours prior to departure. Customers having purchased air only must reconfirm their return flight within 24 to 72 hours prior to the scheduled take-off time.
2. Airport check-in:
Check-in opens at least three (3) hours prior to departure and closes fifty (50) minutes prior to departure. We highly recommend that you check in three (3) hours prior to departure. It is customer’s responsible to be at the airport on time and, after check-in, to proceed on your correct gate by the time specified on your boarding pass. VARAPLAYA TOURS cannot be held responsible if you miss your flight.
3. Baggage allowance
Air carriers have individual rules and regulations with respect to baggage weight size and number. Customers must check your travel services documents for details on baggage allowance and updated baggage regulations.
Baggage delayed, lost or damaged while boarding or disembarking must be reported to the airline representative before leaving the airport. Passengers' baggage and property are transported, stored and handled at owner's risk at all times.
4. Connecting flight:
Passengers connecting VARAPLAYA TOURS’ flights are advised to allow ample time (minimum 3 hours, preferably overnight) between flights. All connecting flights reservations are made at the risk of the customer, who hereby agrees to assume the cost of any loss in the event of a change to the original flight schedule. VARAPLAYA TOURS cannot be held liable for damages or additional fees incurred by consumers owing to a missed flight connection.
5. No Show passenger:
All passengers are not shown on time of check-in or boarding gate will be considered as no show passengers, VARAPLAYA TOURS cannot be held responsible if you miss your flight. No refund of the total amount of the products including taxes.
IN DESTINATION:
1. Hotels and services:
The quality ratings of all hotels are set in accordance with the normal standards of the destination and may be different from Canadian hotel standards.
2. Hotel check-in & check-out:
Regardless of your flight arrival or departure time, most hotels expect departing guest to vacate rooms by 12 noon and arriving guests to check-in after three (3) pm.
The hotel will advise the customer of the check-out time when he/she checks in at the hotel. Whenever meals and/or drinks are included in the package, customers are eligible for meal and drink services from the time they check in to the time they check out.
3. Construction:
To maintain the quality of services, hotel complexes must regularly undergo maintenance, improvement and renovation work and, in some instances, consider expansion. Whenever construction or renovation work that is likely to interfere with the use and enjoyment of any accommodation is brought to the attention of VARAPLAYA TOURS, every reasonable effort will be deployed to promptly notify customers.
4. Optional tours & activities:
VARAPLAYA TOURS cannot be held responsible for sporting or other activities, excursions or optional tours sold at destination, as these services are not operated by VARAPLAYA TOURS featured are all at extra charge, subject to change and availability. Any written or oral contract for all such activities and/or services shall be deemed to be made between customers and the operator of such activities and/or services and shall be undertaken at the customers' own risk of loss, damage or injury. VARAPLAYA TOURS shall not be liable in any manner for any complaints or claims that may arise as a result of participation in any such activities and/or services which are offered by third parties over whom VARAPLAYA TOURS has no control.
BROCHURE PRESENTATION:
All information’s and photographs or pictures appearing in the VARAPLAYA TOURS products' descriptions on this brochure should be used solely as an indication and shall not be construed as part of these Terms and Conditions. Customers are advised to make their selection according to price, location and services offered. Decor and furnishings may vary from room to room, in accordance with the individual location on the hotel premises.
RESPONSIBILITY:
TOUR OPERATOR’S RESPONSIBILITY
VARAPLAYA TOURS makes arrangements with airlines, transfer, operators, hotels and other suppliers that provide the services that you purchase. Although we take care in selecting these suppliers, they are all independent parties and we have no control over them and cannot be held responsible for their omissions, fault or negligence, or that of their employees, nor for any loss or damages suffered as a result thereof. Travel Services provided are subject to the conditions imposed by the service providers and their liability is limited by their tariffs, conditions of carriage, tickets, vouchers, international conventions and agreements.
VARAPLAYA TOURS shall not be liable for failure in the performance of any of its obligations, including without limitation, for any loss or damage resulting from any delay, cancellation, adverse weather conditions, loss of personal belongings, illness, bodily injury, accident, death, deterioration of Travel Services, inconvenience, loss of enjoyment, disappointment or frustration, either mental or physical, due to:
- An Act of God or Force Majeure or third party wrongdoing;
- A war, revolution, insurrection, riot, blockage, terrorism or act of terrorism, or any other unlawful act against public order or authority;
- Fire, flood, explosion, earthquake, epidemics, quarantine, storm, lightning, hurricane, tropical storm, tornado or tropical storm;
- Accident to or failure of an aircraft or equipment used in connection therewith, loss of or hijacking of an aircraft, or any shortage of or inability to provide labor, fuel or facilities;
- Any government order, regulation, action or inaction or any failure to obtain the approval of a government authority having jurisdiction in the circumstances as may be required to the conduct of operations hereunder or any government or legal restraint upon such operation;
CUSTOMER RESPONSIBILITY:
Standards of living vary greatly from country to country. Be advised that living conditions may be different in respect to provision of utilities, services, food and accommodations from those with which you are familiar. VARAPLAYA TOURS does not accept responsibility for any illness or inconvenience resulting from the service provided or omitted at the resort or destination.
Customers are responsible for advising VARAPLAYA TOURS of their intentions, expectations and needs, as they relate to the proposed travel, before the reservation is completed.
Customers whose physical condition so requires must ensure that they have a sufficient quantity of any required medication with them, and that they must carry such medication in their hand baggage at all times. Customers must also consult competent medical authorities prior to departure about preventive medical measures to be taken as regards to the countries to be visited.
The air carrier may refuse pregnant passengers for whom air travel may involve a risk to themselves or their unborn children. A medical certificate establishing the due date and fitness to travel may be required prior to departure.
Sports and activities: Descriptions of sports and other activities contained in the products' descriptions on this brochure are provided for information purposes only and are not meant to incite the customer in any way. VARAPLAYA TOURS cannot be held responsible for any accident or mishap occurring at the destination during the practice of any sport and/or activity in which the customers participate of their own free will and initiative
COMMENTS AND COMPLAINTS:
At destination, customers must contact the VARAPLAYA TOURS representative or the hotel manager immediately to get his assistance and to remedy any problem without delay whenever such problem can be reasonably remedied. The representative can be contacted by telephone or in person when present at the hotel. If a problem cannot be solved or dealt with immediately, customers are requested to forward the specifics of the incident in writing to their travel agent within thirty (30) days of their return to point of departure.

ELECTRONIC DOCUMENTS Passengers must print two copies of the electronic documents, for administration purpose. Cubana de Aviacion authorities will ask one of them.
PASSPORTS AND VISAS a passport valid at the moment of entry and a tourist card is required for all travellers, including infants. It is important for you to know that the Canadian passport should be valid for at least one week after the return date. The tourist card is including your package or air only and is offering at Cubana Airline counter at the moment of check-in, it must be fill up before your arrival to Cuba.
